Privacy Policy

Privacy Policy as of 4 July 2012

General

For Hansgrohe the protection of your personal information is of utmost importance. We collect, process, store and use your personal information only (a) on the grounds of and within the scope allowed by law or (b) with your individual declaration of consent. The sections below inform you about our legal powers, providing no specific reference is made to the need for a declaration of consent.

The Privacy Policy must be read together with our Website Terms and Conditions ("Terms"). To view the Terms, please click here. Unless defined elsewhere, terms in this Privacy Policy shall bear the meaning ascribed to them in the Terms.

In adopting this Privacy Policy, it is our wish to balance our legitimate business interests when collecting and using your personal information and your reasonable expectation of privacy.

By continuing to use this Website, you agree to the terms and conditions of this Privacy Policy. If you do not agree with the provisions of this Privacy Policy, or are concerned about any aspect as it relates to the protection of your personal information, please do not continue to use the Website.

Personal Information we collect

If you access our Website and/or our Website Content, we collect and temporarily save personal information to enable you to use them and to provide you access to the Website. For purposes of this Privacy Policy "personal information" shall mean any information of a personal nature by which you can be identified as an individual such as your name, postal address, email address, telephone number (which will be displayed in the material you submit), home country, postal code, your fax number, gender, age, and/or company name. In particular, we may collect and process the following information (which may include Personal Information) about you:

• identification details (your IP address, possibly user name and passwords);

• information about the start, end, type and scope of your usage and data about your browser type and operating system;

• correspondence between you and us; and

• information that you provide us by filling in forms, using our "Dealer recommendation" or "e-card function" (explained in more detail under the heading "Voluntarily Provided Personal Information" below).

This is a necessary technical process when accessing websites on the World Wide Web. The same applies if you access the content of our newsletters (our newsletters will only be distributed at your request and with your specific consent and you have the right to opt-out of receiving any newsletters from us at any time.).

Voluntarily Provided Personal Information

If you voluntarily provide personal information such as your name, title, e-mail or postal address, telephone number, personal messages etc. via the contact form on our Website, by e mail or by other post, we save and use this information to provide the requested service (e.g. to send requested information, reply to technical or other questions or react to your Website feedback).

You can apply for positions (e.g. jobs, dissertation-related work or apprenticeships) at an inland Hansgrohe group company on an application form on our Website. The personal information supplied by you using the form (including document appendices) will be forwarded to the inland company that has advertised the position. This will only occur for the purpose of carrying out the application procedure. Once we have forwarded your personal information, we immediately delete it. The company advertising the position will delete this information by no later than six months after the application process has been completed providing there is no legal obligation to store the information for longer.

You can use the specialist dealer search on our Website to address enquiries to the specialist you have selected. We do not check the information you have provided; we immediately forward your enquiry to the specialist dealer, who then receives the information you have provided, including your personal information. We delete this information after forwarding it unless you want to take part in the evaluation of the specialist dealer or we have a legal obligation to store the information for longer.

If you use the ‘Dealer recommendation’ function, we save the e-mail address, mobile telephone number and names that you supply for the sender and recipient, as well as any message you may have entered for the purpose of transmitting the message. Once the e-mail has been sent, we will immediately delete the personal information unless we have a legal obligation to store it for longer.

If you use our e-card function, we save the e-mail address and names that you have entered for sender and recipient, as well as the message entered and your IP address for the purpose of transmitting the message. Once the e-mail has been sent, we will immediately delete the personal information unless we have a legal obligation to store it for longer.

Your personal information will only be used for advertising purposes without your express consent within the strict boundaries of the law. You will not be contacted by e-mail or telephone for advertising purposes without your express consent. In addition, you have the right to opt-out, at any time, of receiving any direct marketing from us. Based on and within the scope allowed by law, we process and use the following voluntarily supplied personal information to the extent necessary (1) to advertise our own offers or (2) to transfer this information to the Hansgrohe group companies for their advertising: affiliation to a target group (e.g. your being a Hansgrohe customer or potential buyer), name, title, degree, job title, description of industry or business, address (but not telephone or e-mail contact information) and year of birth. For the purpose of advertising our own promotions, we also save and use other information that we have legitimately obtained. Where we have transferred the information listed above to companies linked with us for their advertising purposes, these companies are legally obliged to inform you that they have received the information from us (through a note in the advertising material or similar). In such cases, we store information about the source and recipient of the information for two years. You can object to the use of your personal information for advertising purposes at any time. In addition, should you not wish to receive electronic communications from us, you may unsubscribe from such communications by clicking on the "unsubscribe" link attached to any electronic communication sent to you by us or you may e-mail us at info@hansgrohe.co.za

Information about your Usage Behaviour

As we like to optimally adapt our offers and advertising to the needs of our customers, we need information about general customer usage behaviour. We therefore use the user information that we have legitimately collected when enabling the use of our Website Content to compile usage profiles using pseudonyms (see above: [add link to passage ‘Enabling the Use of our Website Content’]). This means that we replace all information in the user data that could indicate your identity (e.g. IP address, user name, passwords) with an abstract feature. The usage profiles will not be merged with information about your person or used for other purposes. You can object to the use of your personal information for the creation of usage profiles at any time.

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, i.e. text files that are stored on your computer, enabling an analysis of how you use the website. The information generated by the cookie about your use of this website is usually transmitted to one of Google's servers in the USA, where it is stored. However, if IP anonymisation is activated on this website, your IP address is abbreviated beforehand within EU Member States or in other states who are party to the Agreement on the European Economic Area. Your full IP address will only be transmitted to a Google server in the USA and abbreviated there in exceptional cases. On behalf of this website operator, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website and internet usage for the website operator. Google will not associate the IP address transmitted by your browser within the scope of Google Analytics with any other data held by Google. You may prevent the storage of cookies by selecting the appropriate settings in your browser software. However, please note that if you do this, you may not be able to make use of the full functionality of this website. You may also prevent the data generated by the cookie, and related to your usage of the website (including your IP address), being captured and processed by Google by downloading and installing the browser plug-in available via the following link: https://tools.google.com/dlpage/gaoptout?hl=en. In view of the discussion surrounding the use of analytical tools with complete IP addresses, we would like to point out that this website uses Google Analytics with the extension “anonymizeIp()” and that consequently IP addresses are further processed only in an abbreviated form to exclude a direct link to persons.

Further, we are using Google Analytics in order to analyse data from AdWords and Double-Click-Cookies for statistical purposes. If you do not wish this, you may deactivate this in the ads preference manager (http://www.google.com/settings/ads/onweb/?hl=en). Closer information to the terms of use and on data protection you will find under http://www.google.com/analytics/terms/us.html or rather under http://www.google.com/intl/en/policies/.

Access to your Terminals’ Information Stores (Use of Cookies)

Our Website uses "cookie" and "web beacon" technology. We use such technology to gather information about your use of the Website and Website Content including details of your operating system, browser version, domain name, and IP address (the IP address is a string of numbers that tells us which server you are using but does not identify you).

We only use cookie technology without your prior consent to enable the use of our Website and/or Website Content. Cookies are text files which contain information that is used, among other things, to identify repeat visitors to our Website. They are stored on your terminal from where they are retrieved by us. A web beacon is a small string of code that represents a clear graphic image and is used in conjunction with a cookie. The use of cookies and web beacons is an industry standard. During our use of cookies and web beacons, we do not collect and store any personal information without your specific prior consent, in particular we abbreviate your IP address so that no link to your person can be established. Furthermore, we only collect and store information about the options you have selected (e.g. language, country pages, B2B or B2C offers), product IDs from your notepad or the download centre, frequency and length of visits to the site etc. If we wish to use cookies to optimise our contents and advertising in line with your requirements, we will obtain your prior consent. We cannot control or access Cookies used by third party service providers. This Privacy Policy covers only Cookies used by us, and not any Cookies used by third parties.

If you do not wish to receive cookies or wish to delete the information stored on your terminal, you can adjust your browser settings at any time. However, declining the use of cookies may limit your access to certain features of the Website.

The use of the Website by children

The Website is not targeted at children under the age of 18. We will not knowingly collect information from persons in this age group. We encourage parents to talk to their children about the use of the Internet and information they disclose to and on Websites.

External Service Providers

When we collect, store, process and use personal information we are partly supported by selected service providers who, under the terms of their contract with us, act subject to strict instructions which include protecting your personal information from unwarranted disclosure to third parties. We check all such service providers before using their services for the first time and on a regular basis thereafter.

In addition, the Website may occasionally contain links to Third-Party Websites. If you click on the links to Third-Party Websites, you leave the Website. We are not responsible for the content of these Third-Party Websites or for the security of your personal information when you use the Third Party Websites. These third-party service providers and Third-Party Websites may have their own privacy policies governing the storage and retention of your Personal Information that you may be subject to. We recommend that when you enter a Third-Party Site, you review the Third Party Website’s privacy policy as it relates to how such third parties collect, process, store and protect your personal information.

Deletion of Data

Unless otherwise specified in this data protection information, we will delete your personal information by no later than three months after the purpose of its storage has lapsed unless we have a legal obligation to store it for longer.

Interception and monitoring

To the extent required by law, you agree that your communications on this Website may be intercepted, as defined in the Regulation of Interception of Communications Act 70 of 2002 (as amended), by us or any other competent authority.

Disclosure of Personal Information

On rare occasions, your personal information may be shared under the following circumstances only:

• where required by the laws of the Republic of South Africa. In such instances, we reserve the right to disclose your personal information as required in order to comply with our legal obligations, including but not limited to complying with court orders, warrants, subpoenas, service of process requirements or discovery requests;

• under special circumstances where we have reason to believe that such disclosure is necessary to identify, contact or bring legal action against a party who may be breaching the Terms or may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users, or anyone else that could be harmed by such activities.

The personal information we collect is summarised and cannot be linked to any one person. If you do not wish your personal information to be used in this way, please notify us.

Changes to the Privacy Policy

We reserve the right to amend this Privacy Policy at any time to the extent permitted by law. We will notify you about material changes to this Privacy Policy by placing a prominent data protection notice on our Website. The amended Privacy Policy will become effected when posted. It is your responsibility to familiarise yourself with the most recent version of this Privacy Policy.

General

For Hansgrohe SE, the protection of personal data is of great importance. We collect, process and use your personal data exclusively (a) based on and within the scope of the relevant statutory provisions or (b) with your individual declaration of consent. Below we would like to inform you of the processing we engage in, as permitted by law, to the extent that the need for your express declaration of consent is not referred to.

Enabling your Utilisation of our Website Offer

When you call up the offers on our websites, we briefly collect and store the following user data in order to enable your use: your identification features (your IP address, where applicable user names and passwords), details on the beginning, end, nature and scope of your use as well as details regarding your type of browser and operating system. This is a technical process which is required when you call up websites in WWW. The same applies if you access content from our newsletters (except where allowed otherwise, our newsletters are sent only upon your request and with your express consent).

Personal Data Voluntarily Provided by You

If you voluntarily transmit to us via contact forms on our websites, via e-mail or other postal form personal data such as names, title, email or postal address, telephone number, personal messages etc., we store and use this data to provide the requested service (e.g. sending requested information, answering technical or other questions, reaction to your website feedback).

Via an application form on our website you may apply for an occupation (such as jobs, writing your thesis, vocational training) at a Hansgrohe group company in Germany. We pass on the personal data provided by you on the form (including document attachments) to the enterprise that has advertised the position. We do so exclusively for purposes of carrying out the application process. Once we have passed it on, we will immediately delete your personal data. The enterprise advertising the position will delete this data no later than six months after the conclusion of the application process, unless statutory provisions require a longer retention of the information.

If you use our e-card feature, we will store the email addresses and names you give for the sender and recipient, as well as the message entered by you and your IP address to transit the message. Once the e-card has been sent, we will immediately delete your personal data, unless we are under a statutory obligation to retain it. Please see the conditions of use for our e-cards for further information.

Your personal data will only be used for advertising purposes without your express consent within the strict limits provided by law. Without your express consent you will not be contacted for advertising purposes by email or telephone. Based on and within the scope of the applicable laws, we process and use the following personal data voluntarily provided by you to the degree required for purposes of advertising our own offers or for transmitting this data to Hansgrohe group companies for their advertising: your belonging to a certain category of persons (e.g. you being a customer or potential customer of Hansgrohe), your name, title, academic status, profession, branch or business title, address (however not your telephone or email contact data) and year of birth. For advertising our own offers we may store and use in addition to these details any further data that has been legitimately collected by us. To the extent we transmit the data listed above to our affiliates for their advertising purposes, they are legally obliged to inform you that they have received the data from us (by remark to this effect in the advertising material or the like). In this case we store information on the origin and recipients of the data for a period of two years. You may object to the use of your personal data for advertising purposes at any time by contacting us at the address given below.

Information on User Behaviour

As we strive to optimise our offers and our advertising to meet our customers’ needs, we require information on the general utilisation behaviour of our customers. For this reason, using the user data that has been permissibly collected by us in order to allow your utilisation of our website offer, we create user profiles with the aid of pseudonyms. That is to say, we replace with an abstract feature all details in the utilisation data which could allow any conclusions to be drawn as to your identity (such as IP address, user names, passwords). There is no combination of the user profile with data on your person nor any use for other purposes. You may object to the use of your personal data to create user profiles at any time by contacting us at the address given below. In addition, some of our websites have been “tynt” enabled. When you copy and paste content from such websites into emails or post it on social media pages (e.g. Facebook), then the “tynt” tool gives others a direct link to the website and tells us which website has been accessed and shared. This information is collected on a purely anonymous basis. At no time can Hansgrohe see who has shared that data or whom it has been shared with. For more details on the “tynt” tool, please visit www.tynt.com.

Access to the Information Storage of your Terminals (use of cookies)

We use cookie technologies without your prior consent only in order to enable your utilisation of our website offers. Cookies are text files which contain information inter alia for identifying visitors who repeatedly use our websites. They are stored on your terminal and retrieved by us from there. During this processes we do not collect and store any personal data without your express prior consent, in particular we abbreviate your IP address so that no reference to your person can be established. Additionally, we collect and store only details on options selected by you (e.g. language version, country pages, B2B respectively B2C offers), product IDs from wish lists or download centre, frequency and duration of the site visit etc. You can configure your browser settings at any time, should you not wish to receive cookies or in order to delete them from your terminal. If we wish to use cookies for optimising our offers and advertisements to meet demand, we will request your prior consent thereto.

External Service Providers

We are partially assisted in the collection, processing and use of personal data by selected service providers which, in accordance with their assignments, act strictly according to our instructions and which are validated by us before commencing their activities and subsequently monitored on a regular basis.

Deletion of Data

Unless otherwise stated in these data protection notices, we delete your personal data at the latest three months after original reason for retaining it has passed, unless we are under a statutory obligation to retain it further.

Your Rights and Contact Persons

Besides the aforementioned rights, you may at any time demand information on the data stored about you as well as the correction or deletion of incorrect data. Please address your objections, questions, requests for information or deletion, complaints and the like to:
