Offering our customers the highest quality at all times is a fundamental part of the Hansgrohe company philosophy. We therefore offer consumers a voluntary 15 year manufacturer’s guarantee on our products. The conditions and details can be found in the guarantee conditions below.
Hansgrohe shall assume this manufacturer’s guarantee towards consumers and primary customers of Hansgrohe products in addition to the implied warranty to which consumers and primary customers are entitled in terms of section 56 of the Consumer Protection Act, Act 68 of 2008 (“CPA”)(for as far as same applies).
Hansgrohe shall not be liable for any indirect, special and/or consequential damages suffered by consumers and/or primary customers of Hansgrohe products or anyone else, at any time whatsoever or for any reason whatsoever.
Hansgrohe shall not be liable and/or accountable towards consumers and/or primary customers of Hansgrohe products, or anyone else, for any losses and/or damages that they or anyone else may suffer or incur, irrespective the nature, timing or cause thereof and albeit of a direct nature, unless same was caused by the wilfully malicious, grossly negligent and/or fraudulent acts and/or neglects of Hansgrohe or its representatives/agents/employees.
The term “consumer” in this manufacturer’s guarantee shall mean any natural person who owns a Hansgrohe product and has not purchased it for the purpose of resale to or installation for a third party within the scope of his/her commercial or self-employed professional activities.
The term “primary customer” in this manufacturer’s guarantee shall mean a dealer, retailer or other natural or legal person who has purchased a Hansgrohe product from Hansgrohe directly for purposes of resale or installation for a third party within the scope of his/her/its commercial or self-employed professional activities.
This manufacturer’s guarantee shall only be valid in respect of Hansgrohe products purchased by a primary customer and/or a consumer on or after 01/01/2010 (provided that the primary customer and/or the consumer provides the purchase receipt for confirmation of the purchase date of such Hansgrohe product).
Hansgrohe guarantees consumers and primary customers that Hansgrohe products are free from material, manufacturing and design faults.
The latest science and technology at the time of manufacturing of Hansgrohe products is decisive in this regard. The defect giving rise to a breach of this guarantee must have already been present in the Hansgrohe product at the time of manufacturing thereof in order for the a consumer and/or primary customer to have any claim for a breach of this guarantee.
a. This guarantee shall be valid for all Hansgrohe products not listed under b. below, for a period of 15 (fifteen) years from the purchase date by the primary customer or a period of 16 (sixteen) years from the date of manufacture thereof, whichever period expires first in time. The guarantee period shall not be extended due to the provision of services within the scope of this guarantee, especially not in the event of servicing or replacement. In such cases, the guarantee period shall also not start anew.
b. This guarantee shall be valid for the Hansgrohe iBox Hub (article no. 25020190), RainButton (article nos. 25010000 - 25019000 and 25010700 - 25019700), RainButton Qi-Ladepad (article no. 25100000) and Pontos Scout (article no. 15887000) products for a period of 2 (two) years from the purchase date by the primary customer or a period of 3 (three) years from the date of manufacture thereof, whichever period expires first in time. The guarantee period shall not be extended due to the provision of services within the scope of this guarantee, especially not in the event of servicing or replacement. In such cases, the guarantee period shall also not start anew.
III. Written notification of defects
The consumer or primary customer, but not both, shall be entitled to assert the rights from this guarantee by providing Hansgrohe with a written notification of defect within the guarantee period of the relevant Hansgrohe product. The consumer or primary customer must also provide notification of the defect within 2 (two) months of its/his/her detection of the defect, or within 2 (two) months of the time at which its/his/her detection must have been reasonably possible. The consumer or primary customer shall be obliged to prove that the guarantee has not expired (for example, by presenting the purchase receipt related to the relevant Hansgrohe product).
The consumer or the primary customer shall forthwith notify Hansgrohe of the claim providing full details thereof and shall set out the basis on which it/he/she believes that Hansgrohe is liable in terms of the guarantee. Hansgrohe shall be entitled to inspect the alleged defect, and perform any tests in respect thereof, and may do so internally or by means of a third party. Prior to such inspection or testing by or on behalf of Hansgrohe, the consumer or primary customer shall not be entitled to perform any repairs to, or remove or tamper with any part of, the defective Hansgrohe product.
The consumer or the primary customer shall provide such further information as Hansgrohe may require, including details of environmental factors and inspection and repair records.
Hansgrohe shall also be entitled to determine the commencement date of the guarantee period on the basis of the date of manufacturing and/or sale of such Hansgrohe product.
Hansgrohe shall be entitled, in the event of a valid guarantee claim, to repair or replace the product, as it may determine in its sole discretion, within a reasonable time after receipt by Hansgrohe of written notification of the defect in the Hansgrohe product from the consumer or the primary customer.
In the event of a repair, should the consumer or primary customer wish to have the defective Hansgrohe product repaired by a third party specialist on site then, provided such repair occurs with the prior agreement of Hansgrohe, the guarantee shall cover the free delivery of the necessary spare parts. If Hansgrohe issues a written decision to conduct the repair itself, Hansgrohe shall bear any costs that arise for spare parts, installation and labour, as well as any expenses incurred through the transportation or dispatch of the spare parts. The consumer or primary customer must provide access to the Hansgrohe product.
In the event of a replacement, the old Hansgrohe product shall be replaced by a new Hansgrohe product of the same kind, value and type. If the Hansgrohe product in question is no longer manufactured at the time at which the defect is reported, Hansgrohe shall be entitled to supply a similar Hansgrohe product. Transport or dispatch to and from Hansgrohe or to and from a primary customer, any de-installation and re-installation of the Hansgrohe product or any other special measures can only be carried out with the prior agreement of Hansgrohe. If Hansgrohe agrees to the intended measures aforementioned, Hansgrohe shall bear the costs arising from the measures being conducted. Unless otherwise agreed, the new Hansgrohe product shall be collected from Hansgrohe or the nearest Hansgrohe primary customer as Hansgrohe may direct.
This guarantee shall only be valid if installation and maintenance of the Hansgrohe product has been duly conducted in accordance with the usage/operating instructions and generally accepted engineering practices (e.g. by a master craftsman or authorised specialist), the operating instructions have been complied with and the Hansgrohe product has been used in line with the technical and maintenance instructions provided by Hansgrohe.
This shall include but not be limited to the inlet water pipes being duly flushed, especially prior to the Hansgrohe product’s installation or following construction measures in accordance with the valid standards, installation work complying with the appended diagrams and checks being conducted on the compliance of the working pressure in the water mains with technical specifications.
Installation, usage/operating and maintenance instructions are provided with all Hansgrohe products and can be found at www.hansgrohe.co.za.
The guarantee shall not cover:
• Wear to wear and tear parts such as seals;
• Breakage of breakable components such as glass or bulbs;
• The exhaustion of consumable materials such as batteries, filters or aerators;
• Slight deviations of the Hansgrohe products from the target quality that do not affect the usability of the product;
• Cleaning, water jets, in particular hot water jets, lime-scale deposits, operating and handling errors, damage caused by aggressive environmental influences, chemicals or detergents;
• Product defects caused by the installation, transportation or test operation of the purchased item;
• Damage caused by the defective Hansgrohe product;
• Display products and similar.
The guarantee shall not be valid in the event of:
• Non-compliance with the installation, maintenance and usage/operating instructions related to the Hansgrohe product, appended or provided at www.hansgrohe.de;
• Installation, maintenance, repair or servicing of the Hansgrohe product by non-qualified persons; Damage to the Hansgrohe product caused by the consumer, the primary customer, plumbers or third persons;
• Damage to the Hansgrohe product that can be attributed to normal/fair wear and tear;
• Improper installation or commissioning of the Hansgrohe product;
• Insufficient or improper maintenance of the Hansgrohe product;
• Use of the Hansgrohe product otherwise than in line with its intended purpose;
• Damage to the Hansgrohe product caused by force majeure, natural disasters or other external causes outside Hansgrohe’s control including, but not limited to pollution, incorrect cleaning or incorrect use, fire, floods, frost, explosion, abnormal climatic or weather conditions, acts of God, natural disasters, vandalism or other malicious damage caused due to industrial action.
If a Hansgrohe product defect is not covered by this guarantee, any costs that arise from the dispatch and transportation of the Hansgrohe product shall be borne by the consumer or primary customer, as the case may be. The consumer or primary customer, as the case may be, must also bear any costs, including labour costs, arising from the inspection of the Hansgrohe product, as well as the costs of de-installing and re-installing the Hansgrohe product.
If, having been informed of the non-applicability of the guarantee and the potential costs that could arise through the servicing activities, the consumer or primary customer, as the case may be, wishes the servicing activities to be conducted, it must also bear the costs of the spare parts and labour.
If the Hansgrohe product defect was not present upon delivery, Hansgrohe shall decide on a case-by-case basis whether said defect can be rectified through goodwill. In such cases, the consumer or primary customer, as the case may be, shall not have any legal right to the rectification of the defect.
In addition to the rights from the guarantee, the consumer and/or the primary customer shall also be entitled to statutory rights. These sometimes are lesser rights for the consumer and/or the primary customer shall not be restricted by the guarantee. The guarantee shall also not affect the rights of the primary customer and, where applicable, the consumer in relation to the primary customer from whom the consumer procured the Hansgrohe product.
This guarantee shall be subject to the laws of the Republic of South Africa. The place of fulfilment for the obligations under this guarantee shall be Johannesburg, South Africa. Where permissible, the place of jurisdiction shall be Johannesburg, South Africa.
